1. General
These Terms and Conditions govern your use of www.justmodernfurnture.com.au (“our website”) and the purchase of products from our website. These terms also apply to the purchase of our products on 3rd party websites such as eBay etc. If you have purchased from Just Modern Furniture you are bound by the terms and conditions of our service. Our website is owned and operated by Just Modern Furniture (ABN 16 637 045 419 ). By using our website and buying products via our website, you agree that you have read, understood and accepted these Terms and Conditions. This has the same force and effect as if you had actually signed these Terms. In these Terms and Conditions: ‘we’, ‘our’ and ‘us’ refer to Just Modern Furniture and ‘you’ and ‘your’ refer to the customer/buyer (you).
2. Pricing
Our product prices are set out on our website and may be updated from time to time. All prices are in Australian dollars and, unless we state otherwise, all prices are inclusive of GST.
All prices are subject to change without notice and all purchase orders are accepted by us, on the condition that they will be invoiced at the prices ruling at the date of dispatch.
3. Orders & Payment
Your order is an offer to enter into an agreement with us. No agreement is created until your order and accompanying payment have been accepted and processed by us and we have confirmed this to you. Payment must be made in full at the time of your order. Once we have confirmed your order you are bound by the order, except where at the time of confirmation the product is not in stock.There may be unforeseen circumstances under which it is not possible for us to supply a product at all. If this occurs, it may be necessary for us to cancel orders for that product. We will refund or cancel your payment, but will not accept liability for any other loss or damage arising as a result.
4. Privacy and Payment Security
Our website is hosted with one of the biggest e-commerce sites in the world, Big-commerce. The website is secured using their enterprise-level hosting, bank vault security measures. When you enter sensitive information (such as credit card numbers) on our website, that information is then encrypted using the Internet-standard SSL layer technology (SSL). Once in the checkout section of your order, you will notice a Padlock symbol in your browser advising you of this SSL secure connection. We do not sell or distribute the information you provide to us and only use the information for the purposes of your order, account with us or special offers. The server that hosts our payments, PayPal, is the largest online payment system in the world. PayPal encrypt the transmission of all credit card and personal customer information also using the Internet-standard SSL (Secure Sockets Layer) protocol. During the encryption process, information is scrambled into small bits of code that cannot be read as they travel to Paypal or us over the Internet. *Residents of regional WA, QLD, TAS & NT may have slightly longer delivery times. Customers living in a regional, remote or difficult to access area should contact us prior to ordering to confirm delivery fees if any. We reserve the right to charge an additional delivery fee for items in remote areas or some other parts of Australia where delivery is very difficult or costs are extremely high. You will be consulted prior to any charges occurring and you will also have an opportunity to cancel the order, if you feel the additional cost is too high.
IMPORTANT SHIPPING INFORMATION & CONDITIONS
Just Modern Furniture is a leading TV Entertainment Unit manufacturer and furniture retailer and we ship AUSTRALIA WIDE via our national courier partners. As all items are Australian Made and are manufactured upon ordering, we will aim to dispatch your product within the manufacture period shown. In most cases, we provide a free delivery service to our customers, which is unheard of in the furniture industry.
In very rare circumstances, we reserve the right to charge an additional delivery fee for items in remote areas or some other parts of Australia where delivery is not possible or costs are extremely high. You will be consulted prior to any charges occurring and you will also have an opportunity to cancel the order, if you feel the additional cost is too high.
Your item will arrive to you by a nationwide one man courier service between Monday to Friday. We do not offer a white glove or premium delivery service. If you require a premium delivery service, you will need to pay for and make your own arrangements, and we will work with you to achieve this.
You will need to assist the courier to lift and carry your product to the door in most cases, as most national couriers only operate with 1 driver. Most boxes for your item will be 20-50 kg and should be easily carried by the average person. If this is not possible, please contact us to arrange for an additional person to assist. A minimum fee of at least $150 will apply for this, however an exact price will be quoted to you upon request.
PLEASE NOTE : DUE TO HEALTH AND SAFETY THE DELIVERY PEOPLE ARE NOT ALLOWED TO DELIVER INSIDE THE HOUSE / APARTMENT / UPSTAIRS
99% of orders are dispatched within our quoted periods, however they are best estimates only. Minor delays due to issues outside of our control, public holidays or peak periods such as Christmas may occur in rare circumstances. The design and manufacture of custom items is a complex process, so please be patient if a delay occurs.
We are not liable for any delays or costs incurred to you in relation to the delivery of your product, your arrangements for installation or assembly of your product via a 3rd party. Therefore please make all necessary arrangements for your delivery and do not book in tradespeople, builders or installers until your item has arrived and that you have checked the condition of the item and have confirmed all its parts and materials. If you have any questions related to this, please contact us.
Upon dispatch of your item, you will be emailed by us with courier contact details as well as tracking details. You can then track your item via the courier website or by emailing the company. The courier will email you on the morning of delivery, advising of its arrival on that day. Free re-delivery of items is offered in the event of delivery being missed on the first occasion. You will have the opportunity to re-book through the courier company in the event this happens.You may also be able to arrange a day and time for delivery by contacting the courier and making arrangements with them or by paying additional fees, for the courier to provide you this service.
Please check your delivery upon arrival. In the rare event your item is damaged, you must check the package and advise the courier to note this on the consignment. It is the responsibility of receiver to check the goods and confirm whether the item is received in full and in good condition. Not doing so, may cause issues with replacement. Please contact us immediately in the event this occurs or if only part of your order arrives.
Pickup from our Melbourne manufacturing factory is usually not available, unless arranged prior with our staff. Please do not attend warehouse to collect or view items unless an appointment is made prior.
Deliveries to PO boxes are not accepted, therefore a street address is required. Delivery is to your front door for homes or ground floor only for apartments/high rise buildings.
If shipping address is or will be unattended at the time of delivery, or you cannot accept delivery, please contact the courier or us as soon as possible. In the event of this occurring, the courier will most likely leave a card with contact information at the residence. Please contact the courier company as soon as possible to arrange re-delivery.
We can also make arrangements with the courier, to get approval to leave the goods at your premises unattended. Please note however, Just Modern Furniture will not be liable or cover any loss, theft or damage to your item in this situation or any other loss which relates to the shipping and delivery of your item(s).

6. Pick up
Pickup of some items and orders may be possible at our Warehouse/Showroom at 1/10 Remount Way Cranbourne West Vic 3977. Please contact us to make an appointment prior to arriving and to confirm that the items wanted can be picked up.
7. Returns & Refunds

If you have been approved for a return, you may do so by sending item to 1/10 Remount Way Cranbourne West Vic 3977.
Just Modern Furniture manufactures all TV Units and Floating Wall units made to order.
Due to the fact each order is bespoke and specifically made to your requirements, we are unable to accept returns or order cancellations for change of mind.
Please choose extremely carefully in terms of sizes, shipping options, finishes etc prior to ordering and ensure you have read the shipping times and terms and conditions. Failure to do so, will not be a valid reason for cancellation or return of the product.
Please note, we are not required by the laws of Australia to provide a return or allow cancellations. Therefore in rare circumstances or upon a dispute, if we are forced to cancel or return an order, the costs incurred by us at the time of the cancellation or return, will be charged prior to refunding any amount, if at all. This amount is at our discretion dependant upon the circumstances. We are not required to provide any proof or explanation of these costs.
9. Limited Warranty
Warranty Period
Just Modern Furniture is committed to offering all Australians quality furniture that is built to last. The Products supplied to you will, under normal use be free from defects arising from the manufacture of the product. All our products come brand new and have 10 years warranty.
In the unlikely event if the products you purchased become faulty or damaged within this period that you need to make a claim against this Warranty. We reserve the right to fully assess the product to determine the nature of the defect (if any). In the case of a minor failure, a suitable remedy will be made available to you. In the case of a major failure, we will endeavour to fully replace the item at the earliest possible date/time or make alternative arrangements with you.
Warranty Periods commence from the date of delivery of goods purchased on your Tax Invoice. If a Product is replaced under this Warranty, the Warranty Period for that replacement Product expires on the same date as the Warranty Period for the original Product, a further warranty period is not granted.
This Warranty only applies to Just Modern Furniture Products that:
- Are sold by Just Modern Furniture or any of its approved suppliers.
- This Warranty is valid from the date of payment in full, Warranty Period does not recommence if a Warranty claim is made.
- Has remained installed at the location it was first installed,
- Applies to the original purchaser only and for products used for reasonable domestic purposes. It excludes products used for commercial reasons.
Exclusions
- Normal wear and tear, including pilling, fading, loss or deterioration (of the whole product or its components)
- Damage caused by improper use, cleaning, negligence, treatment, transportation, storage of the products or otherwise caused by your acts and/or omissions
- Damaged caused through any modifications, alterations, improper assembly, Improper Installation, tampering or products used in an abnormal manner and not for the products intended purposes
- Damage caused by exposing the products to the sun, extreme heat or cold, or chemicals/agents that are known to damage the finish of the product
- Damage caused by spills, dyes or other corrosive materials, ink, paint or bodily fluids.
- Damage caused by improper cleaning, cuts from sharp objects, burns, general negligence, and exposing the product to the sun or high heat.
- Damages caused by Act of God, Theft, vermin or insect infestation
- Defects in products that are sold “As Is” which were brought to your attention on purchase
- Items that are altered or modified by yourself or any 3rd party, without our consent, will cause your warranty to be void and will also void any rights to return or make claims against the item.
- Products used for commercial purposes
- Use of non-authorised/non-standard parts
- Damage caused as a result of Incorrect assembly.
- Non reported issues that have escalated from minor to major.
- Water damage – Including damage from steam, excessive moisture
- Heat damage – From placing hot pans, pots or similar hot objects directly on the surface of the Product, including damage consisting of cracks in and scorching of the Product
- Placing heavy objects on the Product; applying substantial weight to the Product, including by standing, sitting or lying on the Product; or applying excessive impact to or mishandling the Product, including the impact caused by objects scraped along, thrown or dropped on the product’s surface
- Exposing the Product to acidic food products such as salt, vinegar, tea and citric fruit juice; or Chemical damage - Exposing the Product to acidic or corrosive materials, cosmetics and chemicals such as dyes, solvents, bleach, inks, acetone, denture cleaner and photo developing fluid
- Using inappropriate household cleaning products – DO NOT USE abrasive cream or powder cleansers, furniture polish/wax/ powder; oven cleaner, drain cleaners, sugar soap and strongly alkaline or acidic cleaners.
- Structural or support changes – Changes affecting the building or application where the product has been installed, causing twisting, warping, bowing, cupping or shrinkage of the Product, including movements caused by hydrostatic pressure resulting in the expansion or contraction of the cabinetry or other structure on which the Product is installed
- Inappropriate use – Including use of the Product outdoors or in any way which exposes the Product to UV (exposure to direct sunlight) or consistent environmental forces that could affect the Product;
Cost claim – Just Modern Furniture will be liable for the cost of the replacement Product at the subject of this Warranty for the Warranty Period. All other costs will be the claiming party’s responsibility
10. Assembly
Improper assembly/installation, abnormal use/misuse/abuse of the product (s) or parts will not be covered under Warranty, so please be extremely careful when assembling the items, in particular, MDF and gloss items which can be damaged easily during assembly.
We highly recommend using the foam and padding materials provided in most items packaging to protect the item during assembly. We also highly recommend not forcing/pushing/tapping/hammering any parts into place unless you are absolutely sure that all dowels/screws/bolts etc. are correctly aligned and that you have followed instructions carefully.
Just Modern Furniture, will not accept any responsibility or liability, refund or replace any product or parts in regards to damage caused during assembly. If you do not feel comfortable assembling your item, please seek professional assistance.
FLOATING CABINETS
NOTE - Our floating/wall mountable products are Floating Designs only - We do not sell a kit or system or anything that suggests, what you buy from us is enough to mount the product. We do not provide any guarantees that the product can be wall mountable/floating without the adequate support of brackets or mounts or additional fixings to hold the cabinet on the wall. Product must be mounted by a professional licenced cabinet specialist using mounts and brackets. Mounts/Brackets/Fixings are NOT Included and must be purchased elsewhere. Specialist must assess your situation and create an adequate solution for your needs - Floating Designs come with a solid 18mm MDF Back Panel which is recessed 20mm to allow for cabling and assist in attaching brackets and mounts to products. The MDF back panel is not structural and this alone will not be sufficient to mount to wall without additional fixings or brackets. Improper installation may cause damage or serious injury. Just Modern Furniture, will not be liable for damage or injury caused by incorrect mounting, incorrect assembly, or incorrect use. We are also not accountable nor will deal with any matter or issues relating to mounting of the item. Please seek a professional for all mounting requirements and advice .

Just Modern Furniture claims copyright ownership of all information stored on our website, unless expressly stated otherwise. No information stored on our website may be used for commercial or other purposes.
